Question no 45 by Marc Tarabella
Subject: Poor implementation of Regulation (EC) No 261/2004 on air passenger rights
In its answer to my question
on this same subject, the Commission states that Member States are not required to notify it of complaint management or of the remedial action taken by companies in the event of overbooking, major delays or cancellations of flights.
Can the Commission therefore specify what actual data it intends to present in its report to the Parliament and Council on implementation of Regulation (EC) No 261/2004
(1)
on 1 January 2007? How does it plan to ensure uniform interpretation and implementation of the Regulation if it is not informed by Member States of the follow-up given to complaints?
How will it prevent companies from using motives unverifiable by users for not implementing the Regulation and from reducing it to an exercise in style?
