Mr President, I voted for this report because I support the introduction of a provision for establishing the law applicable to non-contractual obligations in the Rome II Regulation. This means that the basic principle should be supplemented by a foreseeability clause. Both the right to privacy and personality-related rights are of paramount importance in a democratic society. This is why I believe that it is vital to be able to have recourse to the justice system when a person’s freedom is violated. At the same time, I think that cross-border disputes should be settled amicably. This will guarantee a suitable balance between freedom of expression and privacy. I should also mention the importance of the benefits which could be gained from improving access to the justice system, in terms of ensuring the smooth operation of the internal market.
