In favour. The rapporteur, and the AGRI Committee voting in favour, consider that the Commission proposal on the Single CMO has not respected the principle that Article 43(3) TFEU needs to be interpreted restrictively. They consider that defining conditions and criteria for fixing aid amounts, export refunds and minimum export prices should remain with the legislators, leaving to the Commission only the fixing of amounts through implementing acts.
Therefore in the report he deleted all provisions related to Article 43(3) TFEU and replaced them by the respective content laid down in the Commission proposal for a Council Regulation (which reproduces the corresponding provisions of the existing Single CMO Regulation No 1234/2007). This approach is more pragmatic and also sensible from a procedural point of view (lege artis).
